Category:Reggae fusion artistsThe Court of Appeal has unanimously rejected the application of the Minister for Justice for an order which would force the Parliament to accept his proposed changes to the law regarding marriage.
The Minister submitted a Bill through the Oireachtas (lower house) which would have changed the definition of marriage to redefine it as a civil partnership.
It passed its second stage in the Dáil last year after the Oireachtas voted 79 to 22 in favour of the move. The referendum was rejected by a margin of 10% by voters who took part in it.
Mr Justice Paul Carney said the Court of Appeal was satisfied that the Minister does not have the power to bring into force the proposed law. He said he accepted the position of the Attorney General, who said the proposed change could only be made by legislation.
The Court of Appeal delivered its judgment in a two-page written decision which agreed with the views expressed in the Attorney General’s written submissions.
The Court of Appeal pointed out that when legislation is introduced into the Oireachtas, it is never deemed to have been enacted unless the relevant Bill is adopted by the Oireachtas.
